Article 2 - Applicability

These general terms and conditions apply to every offer made by Kind Essentials and to every distance contract concluded between the entrepreneur and the consumer. By using the Site and/or placing an order, you agree to these terms and conditions and the disclaimer included herein.

Article 3 - The Offer and Information Use

The offer contains a complete and accurate description of the products offered. The information on the Site is intended solely for general informational and commercial purposes. We provide no guarantee regarding the accuracy, adequacy, validity, or completeness of the information on the Site. The use of the information on the Site is exclusively at your own risk.

Article 4 - No Medical Advice

The Site contains information about skincare, wellness, and nutrition. This information does not constitute medical advice and should not be regarded as such. Always consult a physician or another qualified healthcare provider with questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Site.

Article 5 - Products and Results

Any testimonials or "before and after" results on the Site are based on individual experiences. Kind Essentials does not guarantee that you will achieve the same results. Individual results may vary depending on skin type, method of use, and other external factors.

Article 6 - Price and Payment

All prices stated are inclusive of 21% VAT and exclusive of any shipping costs. During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates. Payment must be made immediately upon placing the order via the payment methods offered on the Site.

Article 7 - Delivery and Execution

Kind Essentials will exercise the utmost care when receiving and executing product orders. The ultimate delivery period is 30 days, unless a shorter period has been agreed upon. If an order is delivered in multiple parts (for example, combining our own collections and external partners), the consumer will be informed accordingly.

Article 8 - Right of Withdrawal

When purchasing products, the consumer has the option to dissolve the contract without giving any reason for a period of 14 days. This cooling-off period commences on the day after the product is received by the consumer.

Article 9 - Exclusion of Right of Withdrawal, Return Conditions, and Depreciation

  • 9.1. The right of withdrawal does not apply to products that are not suitable for return for reasons of health protection or hygiene, and of which the seal has been broken after delivery. Please note: Once you break the seal of our cosmetics or skincare, your right to return expires permanently.

  • 9.2. After cancellation, you have another 14 days to return your product.

  • 9.3. You will be credited for the full order amount including any shipping costs of the initial shipment. Only the direct costs for returning the package from your home to the webshop are for your own account. We will refund the due order amount within 14 days of registering your return, provided the product has already been received back in good order.

  • 9.4. If you exercise the Right of Withdrawal, you must:

    • Handle any received items and their packaging with care. You may only unpack or use those items (products) to the extent necessary to establish the nature, characteristics, and functioning of the item. If you handle the item in any other way, you are liable for any depreciation of the item caused thereby, unless we failed to provide you with all legally required information about the Right of Withdrawal at or before the conclusion of the Agreement.

    • Return the item (product) within 14 days calculated from the day following the day you gave notice of withdrawal. The direct costs of returning the item are for your account.

    • Return the item as much as possible with all supplied accessories, in its original state and packaging, and in accordance with the reasonable and clear instructions provided to you by us.

Article 10 - Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer.

Article 11 - Intellectual Property

Unless stated otherwise, Kind Essentials is the owner of the intellectual property rights of all material on kindessentials.nl (including texts, photos, and logos). All rights are reserved. You may view this material exclusively for your own personal use.

Article 12 - External Links

The Site may contain links to third-party websites. These external links are not checked by us for accuracy. We are not responsible for the reliability of information on third-party websites.

Article 13 - Limitation of Liability

Under no circumstances is Kind Essentials liable for loss or damage of any kind arising from the use of the Site or reliance on the information provided. Kind Essentials is not liable for indirect damage or allergic reactions due to improper use or unknown personal sensitivities to ingredients, provided these are correctly stated on the packaging.

Article 14 - Complaints Procedure and WebwinkelKeur

  • 14.1. Kind Essentials maintains a clear complaints procedure and handles every complaint in accordance with this procedure.

  • 14.2. If you have a complaint about the execution of the Agreement, you must submit it fully and clearly described within a reasonable time via info@kindessentials.nl.

  • 14.3. We will respond as quickly as possible, but at the latest within 14 days of receiving the complaint. If a complaint requires a longer processing time, you will receive a confirmation of receipt within the 14-day period, indicating when you can expect a more detailed response.

  • 14.4. For complaints, you must always first turn to Kind Essentials. If a dispute cannot be resolved mutually, and Kind Essentials is affiliated with WebwinkelKeur, you can turn to WebwinkelKeur (www.webwinkelkeur.nl), which mediates free of charge. You can check whether we have an active membership via https://www.webwinkelkeur.nl/ledenlijst/.

  • 14.5. If mediation by WebwinkelKeur does not lead to a solution, you can submit the complaint to the independent disputes committee designated by WebwinkelKeur, whose decision is binding. Costs may be associated with this which must be paid by you.

Article 15 - Applicable Law

These terms and conditions and the agreement are governed by Dutch law. Any disputes fall under the exclusive jurisdiction of the competent Dutch court.
